Here’s the problem:

Eastman’s theory hinges on the STATES submitting alternate slates of electors the way Hawaii did in 1960 * and that’s NOT what they engineered here.

They put together false slates of electors, not selected by the states, and submitted them fraudulently to try to up-end the process.

So even if Trump believed it was legitimately in the power of the Vice President, it wasn’t because the alternate electors were fraudulent.

  • In 1960, the election was so close in Hawaii, they legitimately did not know who won by the time of the deadline to submit electors. As a result, the state sent TWO slates, one for Kennedy, and one for Nixon, with the instruction that only the slate for the actual winner should be counted and the winner should be known by the time the slates were counted.

Kennedy won, his slate was counted, Nixon’s was thrown out… by Vice President Nixon.
