Donald Trump has violated the gag order placed on him during his NY trial ten times so far. If he keeps violating it, what should Judge Juan Merchan do?

proactivepaul ,
@proactivepaul@mastodon.social avatar

@rbreich check the case law on this and see what they did last time (10x violations)

@rbreich Threaten to jail him without backing up the threat?

soundconjurer ,
@soundconjurer@mstdn.social avatar

@rbreich , what he should do appears to not going to be the thing he is going to do. Trump's wrist is going to be a little bit more pink at the end of this trial.

@rbreich

I think he should be shackled into a Hannibal Lecter mask while in court.

They did that to one of the Chicago Seven, right?

It might be funnier to make him wear a ball gag. And a gimp suit!!!

JTashte ,

@rbreich - Judge Merchan knows to tread lightly to avoid adding to the inevitable arguments for a mistrial. But at this point, depending on the seriousness of Trump’s next violation, he should consider holding Trump in contempt and jailing him for 1-2 hours. And work his way up from there.

👩‍⚖️⚖️👩‍⚖️⚖️*The judge should had long time ago put evil Trump in jail and allowed only to go to his trial👩‍⚖️⚖️👩‍⚖️⚖️ Every time Evil Trump breaks his gag order an abuse and dangerous incitement occurs!*Why is this being tolerated with no jail time?👩‍⚖️⚖️👩‍⚖️⚖️

Sentence him to 40 hours of public service, 4 hours for each violation. Give him a trash bag & reflective safety vest and make him pick up trash on the interstate.

@rbreich The real question is why he's been allowed to get away with it ten times.

LOCK HIM UP

Since the threat of jail, it seems the "the Don" has put a muzzle in himself... But, if he breaks it again he has to do time. It he doesn't, he'll get the message that he's basically immune.

IncredulousMike ,
@IncredulousMike@mas.to avatar

@rbreich If you picked a random person off the street and put them where Trump is now, they'd be rotting in a cell. Trump is a rich white guy with a slavishly devoted following, so everybody handles him with kid gloves. If the judicial system continues to let him get away with ignoring the rules, he'll see that these threats have no teeth. No consequences seems much worse in the long run, especially if he manages to get elected again.

@rbreich

Last time, he said the next violation would mean jail "if appropriate." That left wiggle room. On the next violation, he should tell Trump his patience is over and if there's another one, he'll put Trump in jail for 24 hours, adding at least a day to the time for each new violation after that.

Make it certain: one more, and in you go.

kosure ,
@kosure@mas.to avatar

@rbreich It really is the kicker, isn't it. The sad reality is that if he can't be held in contempt, (whether for very valid and practical reasons) then the whole rule of law thing is already gone. Very much like JK Rowling openly flouting Scottish hate speech laws.

@rbreich

Judge Merchan doesn't want to "embarrass" Trump by throwing Trump's ass in jail. After all, as Merchan said, Trump might be the next president, DESPITE THE FACT THAT ACCORDING TO THE 14TH AMENDMENT, SECTION 3, TRUMP ENGAGED IN INSURRECTION OR REBELLION. We all saw him do it, we all heard him and have been hearing him incite violence and promote the Big Lie. I would hope that if by some unholy chance that Trump DID win, people with influence, like Mr. Reich @breich, would initiate a class action suit on behalf of Democratic voters, to enforce 14(3).

That said, Merchan will keep on fining Trump. Anything more would "embarrass" Trump.
